Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") governs use of the Axilrate Platform to ensure lawful, secure, and responsible communication practices. This AUP forms part of, and should be read together with, our Terms & Conditions.

2. Restricted and Prohibited Industries

You must not use the Platform in connection with, or on behalf of, any business engaged in (illustrative and non-exhaustive):

Adult content, pornography, escort services, or sexually oriented products or services

Gambling, betting, lottery, or games of chance, unless separately and expressly authorized in writing by Axilrate and permitted under applicable law

Unlicensed or unregistered financial services, lending, cryptocurrency exchange or trading, or forex trading schemes

• Multi-level marketing, pyramid schemes, or chain referral schemes
• Sale of weapons, ammunition, explosives, or hazardous materials

Sale of narcotics, controlled substances, or unregulated/unlicensed pharmaceuticals

• Counterfeit, pirated, or intellectual-property-infringing goods

Any business Axilrate determines, in its sole discretion, poses undue reputational, regulatory, or platform-compliance risk (including risk to Axilrate's standing as a WhatsApp Business Solution / Tech Provider)

3. Restricted Geographies

You must not use the Platform to target, transmit communications to, or conduct business involving any country, region, or territory subject to comprehensive sanctions, embargoes, or trade restrictions under applicable Indian law, United Nations Security Council measures, or the sanctions regimes of the United States (OFAC), European Union, or United Kingdom, as updated from time to time. You represent that neither you, your beneficial owners, nor any End User you target through the Platform, is a person or entity designated on any applicable sanctions or denied-party list.

4. Consent Requirements

You must:

• Obtain explicit, informed consent prior to sending communications
• Maintain verifiable records of such consent
• Clearly disclose the nature and purpose of communications

5. Messaging Rules

You must not:

• Send unsolicited or bulk spam messages
• Contact users without prior consent or lawful basis
• Send excessive or abusive frequency messages
• Misrepresent identity or sender information

6. Content Restrictions

You must not send content that is:

• Fraudulent, deceptive, or misleading
• Unethical, immoral, or exploitative in nature
• Offensive, abusive, defamatory, discriminatory, or harassing
• Inflammatory, violent, or extremist in nature
• Sexual or sexually suggestive in nature

Political campaigning, lobbying, or election-related, unless separately and expressly authorized in writing by Axilrate and compliant with applicable law

• Promoting illegal or regulated activities without authorization
• In violation of applicable laws or platform policies

7. Data Usage Restrictions

You must not:

• Use purchased, rented, or scraped data
• Process personal data without lawful basis
• Use the Platform for unauthorized data collection

8. Age Restrictions — No Targeting of Minors

8.1 The Platform is not intended for use in targeting, marketing to, or collecting data from individuals under the age of 18 ("Minors").

8.2 You must not use the Platform to knowingly send communications to, or collect, upload, or process the contact details or other personal data of, any Minor.

8.3 If you become aware that a contact list or dataset you have uploaded contains data relating to a Minor, you must remove it immediately and may request deletion assistance through our Data Deletion Instructions & User Data Handling Policy.

8.4 Axilrate does not perform age verification on your behalf. Compliance with this Section 8 is solely your responsibility.

8.5 Where the law of a jurisdiction in which your End Users are located sets the age of legal majority above 18 years, you must apply that higher age as the applicable threshold for "Minor" under this Section 8 in respect of End Users in that jurisdiction, in place of 18.

9. AI-Generated Content

Where you use AI or generative-AI features of the Platform to draft, personalize, or suggest message content, you remain solely responsible for reviewing and approving that content before it is sent, and for ensuring it complies with this AUP in the same way as any other content you send through the Platform.

10. Opt-Out Compliance

All communications must:

• Include a clear opt-out mechanism
• Honor opt-out requests promptly
• Maintain suppression lists

11. WhatsApp & Messaging Platform Compliance

Where applicable, you must:

• Use pre-approved message templates where required
• Comply with session and template messaging rules
• Avoid promotional or unsolicited messaging outside permitted use cases

Violation may result in immediate suspension or reporting to platform providers.

12. Enforcement

Axilrate may:

• Automatically block or restrict campaigns
• Suspend or terminate accounts without prior notice
• Permanently ban repeat or severe violators

13. Monitoring

Axilrate may monitor usage using automated systems to detect spam patterns, complaint rates, and policy violations.

14. Reporting

Axilrate may report violations to regulatory authorities and to third-party platforms (including Meta).

15. Relationship to Terms & Conditions

This AUP is incorporated by reference into, and forms part of, the Axilrate Terms & Conditions. In the event of any conflict between this AUP and the Terms & Conditions, the Terms & Conditions shall prevail.
